Homegy Vietnam is strongly committed to maintaining the privacy and security of confidential personal information and other highly sensitive data that it collects. Our privacy and public records obligations are governed by applicable Virginia statutes, including, but not limited to, the Virginia Privacy Protection Act of 1976, the Virginia Freedom of Information Act and by any applicable U.S. federal laws.
- NOTICE ABOUT THE INFORMATION WE COLLECT
This notice applies to all information collected by or submitted to official Homegy Vietnam websites. The following information explains the Internet privacy policy and practices that the company has adopted for its official websites. This notice should not be construed as a contractual promise, and the company reserves the right to amend it at any time without notice.
When you access our Web pages, the client information and the essential and nonessential technical information listed below is automatically collected—we refer to those categories collectively as “access information.” No other information is collected through our official website except “optional information” sent to us by email or online forms.
- AUTOMATICALLY COLLECTED ACCESS INFORMATION
Client information: The Internet domain and Internet address of the computer you are using. Essential technical information: identification of the page or service you are requesting, type of browser and operating system you are using and the date and time of access. Nonessential technical information: The Internet address of the website from which you linked directly to our website.
Personal Data: when you send us an email we may collect your email address, your name and the content of your email.
Form Data: when you complete online forms, all the data you choose to fill in or confirm, including credit or debit card information if you are ordering a product or making a payment, as well as information about other people if you are ordering a gift and want it sent directly to the recipient’s address.
- THE WAY WE USE INFORMATION
Client information is used to route the requested Web page to your computer for viewing. In theory, the requested Web page and the routing information could be discerned by other entities involved in transmitting the requested page to you. We do not control the privacy practices of those entities. Essential and nonessential technical information helps us respond to your request in an appropriate format (or in a personalized manner) and helps us plan website improvements. Optional information enables us to provide services or information tailored more specifically to your needs or to forward your message or inquiry to another entity that is better able to do so and allows us to plan website improvements.
We may use non-identifying and aggregate information to better design our website. For example, we may report that X number of individuals visited a certain area on our website or that Y number of men and Z number of women filled out our registration form, but we would not disclose anything that could be used to identify those individuals.
We may keep client information from our systems indefinitely after the Web page is transmitted, but we do not try to obtain any information to link it to the individuals who browse our website. However, on rare occasions when a “hacker” attempts to breach computer security, logs of access information are retained to permit a security investigation and, in such cases, may be forwarded together with any other relevant information in our possession to law enforcement agencies.
Under the Virginia Freedom of Information Act, any records in our possession at the time of a Freedom of Information Request might be subject to being inspected by or disclosed to members of the public for any purpose they may desire. As indicated above, client information may be retained after transmission of the requested Web page and might be available for inspection.
We use the information you provide about yourself when placing an order or request only to complete that order or request. We do not share this information with outside parties except to the extent necessary to complete that order or request. Similarly, we use the information you provide about someone else when placing an order or request only to complete that order or request. Again, we do not share this information with outside parties except to the extent necessary to complete that order or request.
We generally use return email addresses only to answer the email we receive. Such addresses are generally not used for any other purpose and by company and state policy are not shared with outside parties.
Finally, we never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without clear notice and the opportunity to opt-out or otherwise prohibit such uses.
Some official Homegy Vietnam websites use “cookies.” Often a cookie enables the company website to tailor what you see according to the way you entered the site (i.e., if you entered by pushing a button identifying yourself as a dealer, your subsequent views of information might be tailored for dealer audiences).
The company may provide email addresses and/or phone numbers collected by the company to digital services, including social media platforms and search engines, for reaching audiences via those services to promote the company and its services. If you do not want such information provided to the company to be used for this purpose, please email support@Homegy.vn with that instruction and include your name and the relevant email address.
- PROVIDING INFORMATION IS YOUR CHOICE
There is no legal requirement for you to provide any information at our website. However, our website will not work without routing information and the essential technical information. Failure of your browser to provide nonessential technical information will not prevent your use of our website but may prevent certain features from working. For any optional information that is requested at the website, failure to provide the requested information will mean that the feature or service associated with that part of the Web page may not be available to you.
- OUR COMMITMENT TO DATA SECURITY
To prevent unauthorized access, maintain data accuracy and ensure the correct use of information, we have put in place appropriate physical, electronic and managerial procedures to safeguard and secure the information we collect online, consistent with the policies of the company and with the laws and regulations of the Commonwealth of Virginia.
II- TERM AND CONDITION
- Acknowledgement and Acceptance
The provision of these Services is conditional upon your acceptance, without modification, of the terms, conditions and notices (“Terms”) contained in this Agreement. Please read this Agreement carefully. If you do not agree to all Terms, please do not use our Services.
Use of the Services is permitted only to individuals who can form legally binding contracts under applicable law. If you do not qualify, please do not use our Services.
In-home Tech Services include installation, set-up, troubleshooting, and tutorials for products purchased at Homegy.Smart Home/Office Services include installation and setup of smart home products purchased at Homegy.Homegy, through its employees or agents, will provide the Services. The Services will be performed at the location indicated on your original invoice.
The following are not included in the Services of this Agreement:Physical maintenance, repair or replacement of any product,
Replacement cost of lost or consumer replaceable parts (such as lightbulbs, racks, shelves, trays, knobs, or dials, etc.)
Fees owed to third party providers,
The disposal of any packaging and debris;
Any hardware, devices, peripherals, software, cabling, power cords, surge protectors, etc. necessary for the performance of the Service.
Access: You agree to provide Homegy’ employees or agents with immediate clear access to any areas and equipment necessary to perform the Services.
Back up: It is your responsibility to back up all existing computer files by copying them to another storage medium prior to the use of the Services. Homegy, its employees and agents will bear no liability whatsoever for any damage or loss to data or peripherals. Homegy can assist you with backing up your important data in-store for an additional fee.
Pets: All pets must be secured in an area separate from Homegy’ employees or agents while the Services are being performed.
Passwords: You agree to assist Homegy’ employees or agents by providing or typing in any passwords or other information necessary to perform the Services.
Permits: You are responsible for obtaining any permits or authorizations that may be required to perform any of the Services.
Internet Requirements: You must have an Internet Service Provider and your Internet connection must be activated and working properly prior to any Services being performed. If network connectivity is desired for multiple devices, you must provide the necessary equipment (i.e. router, hub, modem, or switch) with an adequate number of ports to support the required number of devices.
If the Services require drilling, wire fishing or screw plugs to be inserted into the walls of the premises, you assume all responsibility for any damage, however caused. Homegy’ employees or agents will make best efforts to patch any drywall if needed during the installation process; however, you assume all responsibility for any sanding and painting of the patched area.
The Services purchase price is set out on your purchase invoice. This price must be paid in full when you order your Services.
Your order for Services will be confirmed and you will have entered into a binding contract with Homegy when you submit your order in-store and it is confirmed by email.You may cancel or reschedule your Smart Home Services appointment at least 24 hours before your scheduled appointment by calling 1-833-619-2739 or by responding to the order confirmation email. You may cancel or reschedule your In-home Tech Services appointment in person at the store of purchase at least 24 hours before your scheduled appointment. If you cancel any Services in less than a 24-hour period before your appointment, you must pay a $59 cancellation fee.At its option, Homegy may cancel Services and you will forfeit your Services purchase price if (a) at least one adult, 18 years or older, is not present at the start of and throughout the duration of the appointment, (b) the premises is deemed, in the sole discretion of Homegy and/or its agent, to be an unsafe environment, (c) the necessary equipment or services (i.e. internet) for the Services are not present, (d) if the smart home product requires the input of your credit card information for the product to be installed and you are unwilling to do so, (e) the mobile devices, internet speed, and/or bandwidth do not support the intended functionality of the product being installed, or (f) the necessary power and/or wiring are missing at the time of installation.
You agree to indemnify, defend and hold harmless Homegy, its subsidiaries, and affiliates, and each of their respective officers, directors, employees and agents, from and against all loss, liability, claim, demand or suit, including reasonable legal fees, resulting from or arising out of any of your acts or omissions.
Homegy, its subsidiaries, and affiliates, and each of their respective officers, directors, employees and agents, where applicable by law, shall not be liable for any damages, including direct, indirect, punitive, incidental, general, special or consequential damages, arising out of provision of the Services, including without limitation, bodily injury, emotional distress, and/or any other damages, whether based on contract, tort, strict liability or otherwise, even if advised of the possibility of any such damages. Homegy is not liable for any lost data resulting from the Services or the enforcement of the Terms. Homegy expressly disclaims any and all liability for acts, omissions and conduct of any third party, Services users, advertisers and/or sponsors in connection with the Services or otherwise related to your use of the Services. Homegy’ liability, if any, shall be limited to the Services purchase price. By using the Services, you agree to take reasonable precautions in all interactions with other users of the Services.
Services are covered by a ninety (90) day workmanship warranty that the Services will be performed in a good and workmanlike manner (the “Warranty”). For any product warranty related issues, you should contact the product manufacturer or your warranty provider.You must provide us with written notice of any work defects within the ninety (90) day period following the performance of the Services. You agree that your sole and exclusive remedy is the reinstallation or repair of any defects, in a good workmanlike manner.
You agree that we can collect, use and share your personal information in accordance with our Privacy Policy, available online at www.Homegy.ca.
Choice of Law
You agree that this Agreement and your use of the Services shall be governed by, and interpreted in accordance with, the laws of the province in which the Services were purchased and the federal laws of Canada applicable.
Your purchase invoice and these Terms are intended by the parties to be a final statement of the entire agreement between you and Homegy and supersede all prior written or oral negotiations, understandings and agreements concerning the subject matter of the Agreement.
